1. Parties and Subject Matter

MGC Subcontracting establishes this Privacy Policy, which aims to transparently inform Users about the website hosted at the following address: mgcsubcontracting.com (hereinafter the “Site”), and about how personal data is collected and processed by MGC Subcontracting.
The term “User” refers to any visitor, whether a natural or legal person, who visits the Site or in any way communicates with the Site.
In its capacity as data controller, MGC Subcontracting determines all technical, legal, and organizational means and purposes for processing the personal data of Users. MGC Subcontracting undertakes to take all necessary measures to ensure that personal data processing is carried out in accordance with the Belgian Law of 30 July 2018 on the protection of natural persons with regard to the processing of personal data (hereinafter the “Law”) and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (i.e., the General Data Protection Regulation (“GDPR”); hereinafter the “Regulation”).
MGC Subcontracting is free to choose a natural or legal person to process personal data of Users on its behalf and at its request (hereinafter the “Processor” or “Subcontractor”). Where applicable, MGC Subcontracting commits to selecting a Processor who provides adequate guarantees with respect to technical and organizational measures for personal data processing, in accordance with the Law and the Regulation.
2. Processing of Personal Data
Use of the Site by Users may result in the collection of personal data. The processing of such data by MGC Subcontracting, in its capacity as Data Controller or by service providers acting on behalf of MGC Subcontracting, is carried out in accordance with the Law and the Regulation.
Personal data are processed by MGC Subcontracting in accordance with the purposes listed below, through the following methods:

3. Purpose of Personal Data Processing
In accordance with Article 13 of the Regulation, the purposes of personal data processing are communicated to the User. These purposes include:
- - Ensuring the execution of the services offered on the website
- - Compliance with legal obligations to retain data
4. Personal Data That May Be Processed
The User agrees that, during their visit and use of the Site, MGC Subcontracting may collect and process the following personal data:
Information provided by Users when filling out a contact or purchase form: Name, first name, address, company, position, telephone number, email address, interests.
MGC Subcontracting collects and processes this personal data in accordance with the terms and principles described in this Privacy Policy.
5. Consent
By accessing and using the Site, the User declares that they have read and given their free, specific, informed, and unambiguous consent to the processing of their personal data. This agreement relates to the content of this Privacy Policy.
Consent is given by the positive and active action with which the User checks the box for the privacy policy in the ‘hypertext link’. This consent is an essential requirement for carrying out certain actions on the Site or enabling the User to enter into a contractual relationship with MGC Subcontracting. Any agreement binding MGC Subcontracting and a User regarding the services and goods offered on the Site is subject to the User’s acceptance of the Privacy Policy.
The User agrees that the Data Controller, in accordance with the terms and principles of this Privacy Policy, collects and processes the personal data they provide on the Site or in connection with services offered by MGC Subcontracting for the purposes described above.
The User has the right at any time to withdraw this consent. Withdrawal of consent does not affect the lawfulness of processing based on prior consent.
6. Retention of Personal Data of the User
In accordance with Article 13(2) of the Regulation, the Data Controller retains personal data only as long as reasonably necessary to achieve the purposes for which they are processed.
In all cases, this period shall not exceed two years.
7. Data Recipients and Disclosure to Third Parties
Personal data may be disclosed to employees, collaborators, subcontractors, processors, or suppliers of MGC Subcontracting insofar as adequate guarantees are provided for data security and they work with MGC Subcontracting in marketing products or providing services. They act under the direct authority of MGC Subcontracting and may collect, process, or outsource these data.
In all cases, recipients of the data and those to whom data are provided comply with the content of this Privacy Policy. MGC Subcontracting ensures that they process data only for the intended purposes and in a discreet and secure manner.
In the event data are provided to third parties for direct marketing or prospecting purposes, the User will be informed in advance so that they can give their prior and explicit consent to such use of personal data.
8. Rechten van de Gebruikers

a. Recht van toegang
In accordance with Article 15 of the Regulation, MGC Subcontracting guarantees the User’s right to access their personal data. The User has the right to access such personal data and the following information:
- The categories of personal data concerned
- The recipients or categories of recipients to whom the personal data have been or will be disclosed
- Where recipients are in third countries or international organizations, appropriate safeguards
- Where possible, the proposed retention period for personal data or, if not possible, the criteria for determining such period
- The existence of automated decision-making, including profiling, and relevant information about the logic involved, as well as the significance and expected impact of such processing for the data subject
The Data Controller may charge a reasonable fee based on administrative costs for additional copies requested by the User.
When the User makes this request electronically, the data are provided in an electronic format unless otherwise requested.
The copy of the data will be communicated no later than one month after receipt of the request.
b. Right of Rectification
MGC Subcontracting guarantees the right to rectification and deletion of personal data. In accordance with Article 16 of the Regulation, inaccurate, incorrect, or irrelevant data can be corrected or deleted at any time. The User should make necessary changes via their user account or, if unable, request MGC Subcontracting to do so.
In accordance with Article 19, the Data Controller shall inform each recipient to whom personal data have been disclosed about any correction unless this is impossible or involves disproportionate effort.
c. Right to Erasure
The User has the right to obtain the deletion of their personal data as soon as possible in the cases referred to in Article 17 of the Regulation.
Where the Data Controller has made the personal data public and is obliged, pursuant to the preceding paragraph, to erase such data, the Data Controller shall, taking account of available technology and the cost of implementation, take reasonable steps, including technical measures, to inform other data controllers processing the personal data that the data subject has requested the erasure by such controllers of any links to, or copies or reproductions of, those personal data.
The two preceding paragraphs shall not apply to the extent that such processing is necessary:
- for exercising the right of freedom of expression and information;
- for compliance with a legal obligation which requires processing by Union or Member State law to which the Data Controller is subject, or for the performance of a task carried out in the public interest or in the exercise of official authority vested in the Data Controller;
- for the establishment, exercise, or defense of legal claims.
In accordance with Article 19 of the Regulation, the Data Controller shall inform each recipient to whom the personal data have been disclosed of any erasure or restriction of processing, unless this proves impossible or involves disproportionate effort. The Data Controller shall inform the data subject of those recipients if the data subject so requests.
d. Right to Restriction of Processing
The User has the right to obtain restriction of the processing of their personal data in the cases referred to in Article 18 of the Regulation.
In accordance with Article 19 of the Regulation, the Data Controller shall inform each recipient to whom the personal data have been disclosed of any restriction of processing carried out, unless such communication proves impossible or involves disproportionate effort. The Data Controller shall inform the data subject about those recipients if the data subject requests it.
e. Right to Data Portability
In accordance with Article 20 of the Regulation, Users have the right to receive from MGC Subcontracting their personal data in a structured, commonly used and machine-readable format. Users also have the right to transmit those data to another data controller without hindrance from MGC Subcontracting, in the cases provided for in the Regulation.
Where the User exercises their right to data portability as referred to in the previous paragraph, they shall have the right to have their personal data transmitted directly from one data controller to another, where technically feasible.
The exercise of the right to data portability shall not adversely affect the right to erasure. This right does not apply to processing necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the Data Controller.
The right to data portability shall not adversely affect the rights and freedoms of others.
f. Right to Object and Automated Individual Decision-Making
The User has the right at any time to object to the processing of their personal data due to their particular situation, including the automated processing of data by MGC Subcontracting. In accordance with Article 21 of the Regulation, MGC Subcontracting shall no longer process the personal data unless it demonstrates compelling legitimate grounds for the processing which override the interests, rights and freedoms of the User, or for the establishment, exercise or defence of legal claims.
Where personal data are processed for direct marketing purposes, the User has the right to object at any time to the processing of their personal data for such marketing, including profiling to the extent that it is related to such direct marketing.
Where the User objects to processing for direct marketing purposes, the personal data shall no longer be processed for such purposes.
g. Right to Lodge a Complaint
The User has the right to lodge a complaint regarding the processing of their personal data by MGC Subcontracting with the Data Protection Authority competent for Belgian territory. More information is available on the website: https://www.gegevensbeschermingsautoriteit.be/

The User may also file a claim for injunctive relief with the president of the court of first instance of their place of residence.

10. Limitation of Liability of the Data Controller
The website may contain links to other third-party websites not linked to MGC Subcontracting. The content of these sites and their compliance with the Regulation and the Law are not the responsibility of MGC Subcontracting.
The holder of parental responsibility must give express consent for any minor under the age of 16 to disclose personal information or data via the Site. MGC Subcontracting strongly advises individuals with parental authority to promote responsible and safe use of the Internet. The Data Controller cannot be held liable for the collection and processing of personal information and data from minors under 16 whose consent is not effectively covered by their legal guardians, nor for inaccurate data—especially concerning age—entered by minors. Under no circumstances will personal data be processed by the Data Controller if the user indicates they are under 16 years old.
MGC Subcontracting is not responsible for any loss, damage, or theft of personal data, especially as a result of the presence of viruses or cyberattacks.
11. Security and Protection
The Data Controller implements technical and organizational measures to ensure an appropriate level of security for the processing and collection of data. These security measures depend on implementation costs in relation to the nature, context and purposes of the personal data processing.
The Data Controller uses industry-standard encryption technologies when transferring or collecting data on the Site.
12. Changes to the Privacy Policy
MGC Subcontracting reserves the right to change this Privacy Policy in order to comply with legal obligations in this regard. The User is therefore encouraged to regularly consult the Privacy Policy to be aware of any updates or modifications. Such changes will be posted on the Site or communicated via email to ensure enforceability.
13. Applicable Law and Jurisdiction
This Privacy Policy is governed exclusively by Belgian law. Any dispute will be submitted to the courts of the judicial district of the registered office of MGC Subcontracting.
